This policy explains how we collect, hold, use, disclose, secure and correct
personal information, and how you can access yours or make a complaint. It
applies to this website, our enquiry and application forms, and every part of
the coaching relationship that follows.
Because our coaching involves health and lifestyle information, we handle your
information in line with the Australian Privacy Principles (APPs) set out in the
Privacy Act 1988 (Cth), and with the health-records legislation of the
state or territory you are in where that applies.
2. Dealing with us anonymously or under a pseudonym
You can browse this website without telling us who you are, and you may ask a
general question about our programmes anonymously or under a name of your
choosing. We will answer where we reasonably can.
We cannot coach you anonymously. Building a personalised nutrition and training
plan requires knowing who you are, how to reach you and what your circumstances
are, so anonymity is not practicable once coaching begins.
3. What personal information we collect
We only collect what we actually need. Depending on how you engage with us, that may include:

Contact and identity information — your name, email address,
phone number, and the city or suburb you are in.

Enquiry information — your goal, training experience, the
programme you are interested in, how many days a week you can train, and
anything else you choose to write in the application form.

Health, lifestyle and body information — nutrition challenges,
dietary preferences and restrictions, digestive and gut symptoms you tell us
about, sleep, stress and energy levels, injuries or physical limitations,
medical conditions or medications you disclose, training history, body
measurements, weight, and photographs you choose to send us for progress
tracking.

Coaching records — your plans, check-ins, messages with your
coach, and the notes we keep to coach you well over time.

Payment information — we record that a payment was made and
what it was for. Card and bank details are entered directly with our payment
provider and are not collected or stored by us.

4. Health and other sensitive information
Most of what makes coaching work is sensitive information under
the Privacy Act, and health information carries the strongest protection of all.
We treat it that way.
- We collect it only with your consent, and only where it is reasonably necessary to coach you.
- You choose how much to disclose. You can decline any question, though some gaps may limit how specific your plan can be.
- We use it to build and adjust your programme — not for marketing, profiling or any unrelated purpose.
- You can withdraw your consent at any time by contacting us. Withdrawing consent may mean we can no longer coach you safely.
EatFyt provides nutrition and fitness coaching. It does not replace diagnosis or
treatment from a qualified healthcare professional. Nothing you share with us is
a substitute for medical advice, and we will ask you to speak with your doctor
where that is the right course.
5. How we collect your information
Wherever it is reasonable and practicable, we collect personal information
directly from you — through the application form on this
website, by email or messaging, during consultations, and through your ongoing
check-ins.
We may occasionally receive information about you from someone else, such as a
referral from an existing client or a health professional you have asked to
contact us. Where that happens, we will tell you we hold it and why, unless you
already know.
If we receive personal information we did not ask for and could not lawfully have
collected ourselves, we will destroy or de-identify it as soon as practicable,
provided it is lawful and reasonable to do so.
6. Why we collect it and how we use it
We use your personal information to:
- respond to your enquiry and assess whether our coaching suits your goals;
- design, deliver and adjust your nutrition, training and supplementation guidance;
- keep in contact with you through check-ins and support between sessions;
- process payments and keep the financial and business records we are required to keep;
- improve our programmes and this website, using de-identified or aggregated information wherever possible; and
- meet our legal, tax and insurance obligations.
We will not use your information for an unrelated purpose unless you would
reasonably expect it, you have consented, or the law requires or permits it.
7. Who we disclose it to
We do not sell your personal information, and we do not trade or rent it
to anyone. We disclose it only to:

Service providers who help us operate — website and email
hosting, form handling, scheduling, payment processing, and coaching or
messaging software. They may access your information only to perform that
service for us, and are bound to keep it confidential.

Professional advisers — our accountant, insurer or lawyer,
where genuinely necessary.

Anyone you ask us to — for example, your doctor, physiotherapist
or dietitian, with your consent.

Authorities — where required or authorised by law, or where we
reasonably believe disclosure is necessary to lessen or prevent a serious threat
to someone's life, health or safety.
We never publish your photographs, results, measurements or story
without your specific, separate written consent, and you can withdraw
that consent at any time.
8. Direct marketing and how to opt out
If you enquire or become a client, we may send you occasional emails about
coaching, availability or content we think is useful. We will only ever do this
with information you gave us, and we will not use your health information to
target marketing at you.
Every marketing message includes an unsubscribe option, and you can ask us to
stop at any time by contacting us at the address in section 18. We will action it
promptly and at no cost. You can also ask us to tell you where we obtained your
information.
9. Overseas disclosure
Some of the providers we rely on store or process information on servers outside
Australia. The countries this is likely to involve are
Countries — e.g. United States, Ireland.
Before disclosing your personal information to an overseas recipient, we take
reasonable steps to ensure they handle it in a way consistent with the Australian
Privacy Principles. This website also loads fonts from Google, which means your
IP address is transmitted to Google's servers when the page loads.
10. Government related identifiers
We do not adopt, use or disclose government related identifiers — such as
Medicare numbers, tax file numbers or driver licence numbers — as our own
identifier for you. We do not ask for them, and you should not send them to us.
11. Keeping your information accurate
Coaching decisions are only as good as the information behind them, so we take
reasonable steps to keep what we hold accurate, up to date, complete and relevant.
Please tell us when something changes — particularly a new injury, diagnosis,
medication or dietary restriction.
12. How we store, secure and dispose of it
We hold personal information in access-controlled digital systems protected by
strong passwords and, where available, multi-factor authentication. Access is
limited to those who need it to deliver your coaching. This website transmits
form submissions over an encrypted connection.
No method of transmission or storage is completely secure, and we cannot guarantee
absolute security. If a data breach occurs that is likely to result in serious harm
to you, we will notify you and the Office of the Australian Information Commissioner
as required by the Notifiable Data Breaches scheme.
We keep your information for as long as we need it for the purpose it was collected,
plus any period the law requires us to retain records. Health information is
generally retained for the minimum period set by the health-records law that applies
to you. After that, we destroy it or permanently de-identify it.
13. Accessing the information we hold about you
You can ask for a copy of the personal information we hold about you at any time.
Write to us using the details in section 18. We will ask you to verify your
identity, and we will respond within a reasonable period — normally within 30 days.
Access is free. If a request requires substantial work, we may charge a reasonable
cost-based fee, and we will tell you what it is before we do the work. In the
limited circumstances where the Privacy Act permits us to refuse access, we will
explain why in writing and tell you how to complain.
14. Correcting your information
If anything we hold about you is inaccurate, out of date, incomplete, irrelevant
or misleading, ask us and we will correct it. If we have disclosed the incorrect
information to someone else, you can ask us to notify them.
If we decline to make a correction, we will tell you why in writing, and you may
ask us to attach a statement to your record noting that you consider it incorrect.
15. Cookies, analytics and this website
This website does not use advertising or tracking cookies, and it does not build a
profile of you.
Our web host records standard server information such as your IP address, browser
type and the pages you visited, which is used to keep the site running and secure.
Fonts are loaded from Google, as noted in section 9. If we add website analytics in
the future, we will update this policy and describe what is collected before it
goes live.
You can block or delete cookies through your browser settings. This site will still
work if you do.
16. Children and young people
Our coaching is intended for adults, and our application form is not designed for
anyone under 16. We do not knowingly collect personal information from children.
If you believe a child has given us their information, contact us and we will
delete it.
17. Making a complaint
If you think we have mishandled your personal information or breached the
Australian Privacy Principles, please tell us first — most issues are resolved
quickly. Write to us using the details in section 18 with enough detail for us to
investigate.
We will acknowledge your complaint promptly, aim to respond substantively within
30 days, and tell you the outcome and our reasons in writing.
If you are not satisfied with our response, you can refer the matter to the Office
of the Australian Information Commissioner at
oaic.gov.au.
